Terms of Service

Welcome to Qalakar. Qalakar is an artist identity platform that helps Indian artists present their work, define their craft, and receive booking inquiries — all in one place.

These Terms of Service ("Terms") govern your access to and use of the Qalakar website, mobile applications, and all related services (collectively, the "Platform"). By creating an account or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must not use the Platform.

You must be at least 18 years of age to create an account or use the Platform. By using Qalakar you represent and warrant that you are 18 or older and have the full legal capacity to enter into a binding contract under the laws of India.

If you are using the Platform on behalf of an organisation or business, you additionally represent that you have the authority to bind that entity to these Terms.

One account per person. Each individual may maintain only one active Qalakar account. Creating duplicate or impersonation accounts is prohibited.

Accurate information. You agree to provide truthful, accurate, and complete information when registering and to keep that information current. Misrepresenting your identity, credentials, or artistic background is a violation of these Terms.

Account security. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at hello@qalakar.com if you suspect unauthorised access. Qalakar is not liable for any loss or damage arising from your failure to protect your credentials.

Your content, your ownership. Any text, images, audio, video, or other material you upload to your profile ("Your Content") remains your intellectual property. These Terms do not transfer ownership of Your Content to Qalakar.

Licence to Qalakar. By uploading Your Content, you grant Qalakar a non-exclusive, royalty-free, worldwide licence to store, display, reproduce, and distribute Your Content solely for the purpose of operating and promoting the Platform. This licence ends when you delete the content or close your account, subject to reasonable retention periods required by law or backup cycles.

Your responsibilities. You warrant that Your Content: (a) does not infringe any third-party intellectual property, privacy, or publicity rights; (b) is not false, misleading, or defamatory; (c) does not impersonate any person or entity; (d) does not contain adult, explicit, or obscene material; and (e) complies with all applicable laws.

False claims. Falsely claiming awards, certifications, affiliations, or professional credentials is strictly prohibited and may result in immediate account suspension.

When using the Platform you agree not to:

Introductions only. Qalakar provides a channel through which potential clients can send booking inquiries to artists. We are a facilitator only. Qalakar is not a party to any agreement, contract, or arrangement made between an artist and a client, and we have no responsibility for the performance or outcome of any such arrangement.

Your judgment matters. You are solely responsible for evaluating inquiries, negotiating terms, and deciding whether to accept any engagement. Qalakar makes no representations about the identity, creditworthiness, or intentions of users who send inquiries.

No agency relationship. Nothing in these Terms or on the Platform creates an employment, agency, partnership, or joint-venture relationship between Qalakar and any artist or client.

Qalakar currently offers a free plan. The specific limits applicable to free accounts — including the maximum number of gallery items, booking inquiry slots, and other features — are described within the Platform and may be updated from time to time.

We reserve the right to modify free plan limits. Where we reduce a limit in a material way, we will provide reasonable advance notice (see Section 13 on Changes). Continued use of the Platform after such notice constitutes acceptance of the updated limits.

Qalakar's property. The Qalakar name, logo, brand assets, user interface design, underlying code, and all other proprietary material created by or for Qalakar are owned by Qalakar and protected by Indian and international intellectual property laws. You may not copy, reproduce, modify, or create derivative works from any Qalakar-owned material without our prior written consent.

Your content is yours. As stated in Section 4, ownership of Your Content remains with you. Qalakar claims no ownership over the artwork, photographs, music, or other creative works you upload.

Feedback. If you submit ideas, suggestions, or feedback about the Platform, you grant Qalakar a perpetual, irrevocable, royalty-free licence to use that feedback for any purpose without compensation to you.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

Qalakar does not guarantee continuous, uninterrupted, or error-free operation of the Platform. We do not guarantee the quality, volume, authenticity, or suitability of any booking inquiry you receive.

You acknowledge that use of the Platform is at your own risk.

To the fullest extent permitted by applicable Indian law, Qalakar and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, loss of data, loss of goodwill, or business interruption — arising out of or in connection with your use of, or inability to use, the Platform.

In no event shall Qalakar's total aggregate liability to you for all claims arising under or related to these Terms exceed the amount you paid to Qalakar in the twelve months preceding the event giving rise to the claim, or INR 1,000, whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain liabilities; in such jurisdictions the above limitations apply to the maximum extent permitted by law.

By Qalakar. We may suspend or terminate your account, with or without notice, if we have reasonable grounds to believe you have violated these Terms, engaged in fraudulent or harmful conduct, or if required by law. We will endeavour to notify you where doing so does not compromise any investigation.

By you. You may delete your account at any time from your account settings. Upon deletion, your public profile will be removed. We may retain certain data as required by applicable law or our legitimate business interests, as described in our Privacy Policy.

Effect of termination. Upon termination, your right to access and use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including Sections 8, 9, 10, and 12 — will continue to apply.

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts located in Gujarat, India. You consent to personal jurisdiction in those courts.

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices.

For material changes, we will provide at least 30 days' advance notice by sending an email to the address associated with your account. Non-material clarifications may be posted without prior notice. The "Last updated" date at the top of this page will always reflect when these Terms were most recently revised.

Your continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the Platform and may delete your account.
